Terms of Service

The rules and responsibilities that govern your use of Atherlink products and services.

Acceptance of terms

By accessing or using any Atherlink product, platform, or website, you agree to be bound by these Terms of Service and our Privacy Policy. If you are accepting on behalf of an organisation, you represent that you have the authority to bind that organisation.

These terms apply to all visitors, users, and customers. Enterprise customers are additionally governed by their signed Order Form and Master Service Agreement (MSA), which take precedence over these terms where they conflict.

Use of our services

You may use our services only for lawful purposes and in accordance with these terms. You agree not to use the services to transmit unlawful, harmful, or malicious content; to interfere with or disrupt the integrity of our infrastructure; or to reverse-engineer, decompile, or attempt to extract the source code of our software.

We reserve the right to suspend or terminate access if we reasonably believe you are in breach of these terms.

Accounts and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@atherlink.com if you suspect unauthorised access.

Accounts are non-transferable. You may not share credentials across multiple individuals without an explicit multi-seat agreement.

Intellectual property

All content, software, trademarks, and designs on our platform are the exclusive property of Atherlink Technologies Ltd or its licensors. Nothing in these terms grants you ownership of any Atherlink intellectual property.

You retain all rights to data you upload or route through our platform. By using our services, you grant Atherlink a limited licence to process that data solely to deliver the contracted service.

Service availability and SLA

Atherlink targets 99.98% monthly uptime for production infrastructure, as defined in the applicable SLA addendum. Scheduled maintenance windows are communicated at least 72 hours in advance via status.atherlink.com.

In the event of a material SLA breach, enterprise customers may be eligible for service credits per the terms of their MSA.

Limitation of liability

To the maximum extent permitted by law, Atherlink shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services.

Our total aggregate liability to you shall not exceed the greater of (a) the fees you paid to Atherlink in the twelve months prior to the claim, or (b) £100 GBP.

Modifications to terms

We may update these terms from time to time. We will notify you of material changes via email or an in-product banner at least 14 days before the changes take effect. Continued use of the services after that date constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
